Marriage (matrimonio) in Spanish law is the marriage of man and woman. Since 2005, the requirements and effects of Spanish marriage law have also applied to connections between people of the same sex (Ley 13/2005 of July 1st). As in Germany, the marriage can be concluded under civil law (in front of a judge, mayor, civil servant) but also in church with civil law effect. The marriage becomes fully legally effective upon entry in the civil register = Registro Civil).

Statutory property regime:

In Spanish law is the Sociedad de Gananciales, which should not be confused with the German gain community. In contrast to German law, where, according to a community of gains, a separation of property during marriage with any gain compensation upon termination (divorce, death), the Spanish property regime is a real community in which the property of the spouses after marriage is overall hand-held property. Personal property of the spouses is therefore only that which they acquired before the marriage and that after marriage through inheritance or gift. During the marriage, each spouse can freely dispose of his or her marriage property, with the exception of real estate and the sale of business premises. Here the signature of both spouses is necessary. German spouses who want to buy or sell land or other real estate in Spain should therefore always pay attention to the exact description of their property in Spanish when notarizing. Gaining community should therefore never be translated with sociedad gananciales, but correctly with regimes matrimonial de separaciôn de bienes con participaciôn en las ganancias.
